RELEASE OF LIABILITY AND HOLD HARMLESS AGREEMENT The undersigned, in consideration of the participant being allowed to participate in the 2008 Summer Ball Program conducted by the Pawnee City Boys and Girls Ball Association, Inc. of Pawnee City, Nebraska, herein individually agree to hold harmless the Pawnee City Boys and Girls Ball Association, Inc., Pawnee City, Nebraska, its members, directors, agents, officers, managers, umpires and employees, together with all other persons, organizations, or legal entities involved in any activities conducted from and after the date hereof from any liability by reason of suit or claim for damages or any loss or injury to the participant or property, or death of participant. Coaches, managers, umpires, referees, their assistants, or anyone who prepares any playing field shall NOT be liable for the injury or death of any participant in Summer Ball Program which results from the negligence of any of the above listed individuals. It is understood that this Release of Liability and Hold Harmless Agreement shall not be construed to apply to any willful or grossly negligent act or omission. The undersigned specifically acknowledges and agrees that they assume the risk and all legal responsibility for injury to the participant or any other person or loss of property that may result from participating or being present at any activity related directly or indirectly to the 2007 Summer Ball Program.
